Finder fees and heir finders in Alabama

The legal limit in Alabama: 10% of the value claimed (total compensation); buying or assigning property for a net profit above 10% is prohibited.6 Among the flat caps in our finder-fee comparison, 1 is lower and 11 are higher. You never need a finder: claiming directly is free.8

  • Are finders allowed? Yes, with limits: finder agreements are void if signed from the date property is presumed abandoned until 24 months after it is delivered to the Treasurer (except agreements with an attorney to file a claim for identified property or contest a denial); after that they are enforceable only if they meet the written requirements.6
  • Contract rules: Must be in writing; describe the property and services; state the property is held by the Alabama Treasurer, give contact information, and say it can be recovered from the Treasurer free; be signed by the apparent owner and state the fee percentage and any other deductions. The claimant must give the Treasurer a full, unredacted copy. Fee shares of mineral interests not yet presumed abandoned are void.6
  • The law: Ala. Code § 35-12-93 (as amended by Act 2026-285)6 (read the text)

Before signing with a finder, read how finders work.

The late and willful penalties may be waived for good cause and must be waived if the holder acted in good faith (the waiver clause does not cover the fraud penalty).27

Other rules specific to Alabama

  • Law: Ala. Code §§ 35-12-70 to 35-12-96 (Title 35, Chapter 12, Article 2A), Uniform Disposition of Unclaimed Property Act of 2004; latest amendments by Act 2026-285. Official text: alison.legislature.state.al.us/…29
  • Uniform act: Alabama's own title is 'Uniform Disposition of Unclaimed Property Act of 2004'; the code does not say which Uniform Law Commission version it follows.29
  • Unclaimed safe deposit box contents and other tangible items are auctioned online through the Treasury's auction partner; proceeds are held for owners.2
  • Military items (medals, awards, discharge papers) are never auctioned.15
  • Old coins (1971 or earlier), old paper money (1963 or earlier) and collector sets are auctioned rather than deposited.15
  • Items with historical, artistic or literary value may be displayed by the Alabama Historical Commission or Department of Archives and History instead of being auctioned.15
  • The Treasurer may pause selling stock during a recession (two straight quarters of falling real GDP).15
  • Garnishments and levies against unclaimed property held by the Treasury are not paid.15
  • If the office asks for more information, you have 90 days to answer or the claim is deemed denied.15
  • Only Treasury-approved forms are accepted, altered forms lead to denial, and all documents must be in English.15
  • Cities, counties, their boards and electric cooperatives are exempt from reporting, so money they hold may not be in the state database.22
  • Uncashed State of Alabama warrants (state checks) are void after one year and moved to unclaimed property.20
  • 2026 law (Act 2026-285) added digital assets: crypto held in a digital asset account is presumed abandoned 3 years after the owner's last activity (35-12-72(a)(18)). A claimant gets the asset if the Treasurer still holds it, otherwise the sale proceeds, with no claim for later price changes (35-12-80(d)).30
  • The Treasurer suggests checking the site every year on your birthday, since funds are turned over once a year.9
  • The unclaimed property database isn't for sale; public listing information is only on the Treasury website.15
  • Unclaimed property does not include houses, cars or boats.8
  • The state's own checks and tax refunds are handled by other agencies: Revenue for tax refunds, the Comptroller for other state-issued checks.31
  • Starting no later than January 1, 2028, the State Treasurer must report each year to the Legislature on all unclaimed digital asset activity; the first report must look at whether to hire a qualified custodian to hold crypto in native form.30
  • The program's claim rules are the current official rules: the Alabama Administrative Code shows chapter 892-2-1 (Unclaimed Property Division) with history 'Repealed and New Rule: Filed December 30, 2014; effective February 3, 2015.'32
